However, the location as requested will maximize recovery of hydrocarbons within the unit, thereby preventing waste. Applicant should therefore be granted an exception to Rule:165:10-3-28(c)(2)(b) in order that Applicant's proposed well may be situated closer than 600 feet from the existing well described above. NOTICE IS FURTHER GIVEN that the Applicant in this cause is requesting the following special relief: to designate the Applicant or some other party as Operator of the unit well. Applicant is further requesting that the Order to be entered in this cause be made effective on a date prior to the date of the Order. NOTICE IS FURTHER GIVEN that this cause be set before an Administrative Law Judge for hearing, taking of evidence and reporting to the Commission.
